Brazilian Court Suspends Cancellation of Syngenta’s Product

Brazil’s Ministry of Agriculture and Livestock provisionally reinstated registration No. 06105 for Syngenta’s Engeo Pleno S following a Federal Court decision suspending the effects of the cancellation imposed in September.

The measure is established by Act No. 63, published in the Federal Official Gazette on October 13. The act complies with an October 6 decision by the 16th Federal Civil Court of the Federal District in Writ of Mandamus No. 1106620-28.2026.4.01.3400.

In September, as previously reported by AgriBrasilis, MAPA canceled the product registration through Act No. 59/2026, in compliance with decisions by the Special Commission for Agricultural Defense Appeals (CERDA).

The cancellation resulted from an administrative proceeding related to an infringement involving the product. CERDA’s decision had also provided for the possibility of converting the penalty into a substitute fine and entering into a Conduct Adjustment Agreement (TAC), provided that certain conditions were met.

CERDA subsequently ruled Syngenta’s request for this conversion inadmissible, maintaining the registration cancellation penalty.

The company challenged the decision in court. On October 6, the court ordered the suspension of the effects of Act No. 59 exclusively with respect to Engeo Pleno S until CERDA issues a new administrative decision on the request to convert the penalty into a fine and enter into a TAC.

As a result, Act No. 63 provisionally reinstated the registration for the formulation currently approved by Anvisa, Ibama and MAPA, subject to all other applicable regulatory conditions and restrictions.

MAPA also ordered the status of the registration in the Agrofit system to be updated to reflect the suspension of the cancellation.

The measure, however, does not revoke or annul Act No. 59. According to MAPA, the reinstatement is provisional and will remain in effect until CERDA issues a new administrative decision.
