Brazil’s Ministry of Agriculture and Livestock – MAPA canceled registration No. 06105 of Engeo Pleno, from Syngenta. The measure was established by Act No. 59, published in the Federal Official Gazette on September 18th.
According to the act, administrative proceeding No. 21052.023531/2021-78 “investigated and ruled, at the third administrative level, on an infraction related to the pesticide ENGEO PLENO.”
The cancellation had previously been determined by the Special Commission for Agricultural Defense Appeals – CERDA. Decision No. 90/2026 partially granted the company’s appeal and determined the “CANCELLATION OF PRODUCT REGISTRATION No. 06105.”
The decision based the cancellation on Article 17, item VI, of Law No. 7802/1989 and Article 86, paragraph 5, of Decree No. 4074/2002. Paragraph 5 provides for cancellation when “fraud or unauthorized modification […] in the formula and manufacturing conditions” is identified.
The excerpts from the cited documents do not specify which of these two circumstances supported the application of the penalty in this particular case.
Decision No. 90 also provided for the possibility of converting the cancellation into a substitute fine and a Conduct Adjustment Agreement – TAC, subject to verification that the product remained approved by MAPA, the Brazilian Health Regulatory Agency – Anvisa and the Brazilian Institute of Environment and Renewable Natural Resources – Ibama.
According to Act No. 59, CERDA subsequently decided on the “NON-ADMISSIBILITY” of the request submitted by Syngenta and on the “INELIGIBILITY” for converting the cancellation penalty into a substitute fine and TAC.
The act also states that “administrative appeal channels were exhausted” and that the “penalty of cancellation of the product registration” therefore prevailed.
As of the publication of Act No. 59, production, import, export, commercialization and distribution of Engeo Pleno are prohibited. Products effectively sold to end users before the cancellation may continue to be used until the end of their shelf life.
